1. Acceptance of Terms

By accessing or using VietSpeak ("the Service"), operated at viet-speak.com and through the VietSpeak mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

VietSpeak is a Vietnamese-English translation service that provides context-aware translations with proper pronoun handling. The Service uses artificial intelligence (AI) to generate translations based on the relationship context you provide.

3. User Accounts

• You must create an account to use the translation features. You can sign up with an email address or through Google OAuth.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Free and Premium Tiers

Free Tier

Free users receive up to 5 translations per day. The daily limit resets at midnight. Free access may be modified or discontinued at our discretion.

Premium Subscription

Premium subscribers receive unlimited translations and access to all features. Subscriptions are billed monthly ($4.99/month) or yearly ($35.88/year) through Stripe (web) or through the Apple App Store / Google Play Store (mobile).

5. Payments and Refunds

• Web subscriptions are processed by Stripe. Mobile subscriptions are processed by the respective app store.
• Subscriptions automatically renew unless cancelled before the end of the current billing period.
• You can cancel your subscription at any time through your account settings or the Stripe customer portal. Access continues until the end of the paid period.
• Refund requests for web subscriptions should be directed to us via our contact page. Mobile subscription refunds are handled by Apple or Google per their respective policies.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to circumvent usage limits, authentication, or payment systems
• Use automated scripts, bots, or other means to access the Service in bulk without authorization
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Submit content that is harmful, abusive, threatening, or otherwise objectionable
• Resell, redistribute, or commercially exploit the Service or its translations without our written consent

7. Translation Accuracy

VietSpeak uses AI-powered translation. While we strive for high accuracy, translations are provided "as is" and may not be perfect. You should not rely on our translations for legal, medical, or other critical purposes where inaccuracy could cause harm. We are not liable for any consequences arising from translation errors.

8. Intellectual Property

The VietSpeak name, logo, design, and underlying technology are our intellectual property. You retain ownership of the text you submit for translation. We do not claim ownership of your input or output translations.

9. Limitation of Liability

To the maximum extent permitted by law, VietSpeak and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising from your use of the Service.

10. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
